ORDINANCE NO 3342

AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF CUMBERLAND,MARYLAND ENTITLED AN ORDINACE ENTITLED "AN ORDINANCE TO REPEAL ORDINANCE NO. 2702 PROVIDING FOR THE ADOPTION OF THE 1970 FIRE PREVENTION CODE AND TO REPEAL ORDINANCE NO. 3057 PROVIDING FOR THE ADOPTION OF THE 1988 EDITION OF THE LIFE SAFETY CODE AND TO ENACT A NEW PROVISION OF THE CODE OF THE CITY OF CUMBERLAND PROVIDING FOR

THE ADOPTION OF THE MARYLAND STATE FIRE PREVENTION CODE.

NOW, THEREFORE

SECTION 1-. BE IT OPDAINED BY THE MAYOR AND CITY COUNCIL OF CUMBERIAND, that ordinance No.2702 of the Mayor and City Council of Cumberland be and the same is hereby repealed.

SECTION 2: AND BE IT FURTHER ORDAINED, that ordinance No. 3057 of the Mayor and City Council of Cumberland be and the same is hereby repealed.

SECTION 3: AND BE IT FURTHER ORDAINED, that the provisions of the State of Maryland Fire Prevention Code COMAR Section 29.06.01 and all future amendments or revisions to such code be and they are hereby adopted as the Fire Prevention Code of the City of Cumberland as is thus specifically set forth herein totidem verbis, referenced to such publication being hereby made.

SECTION 4: AND BE IT FURTHER ORDAINED, That this Ordinance shall take effect from the date of its passage.

AMENDMENT 2001-003

AN AMENDMENT OF THE CITY CODE OF FROSTBURG TO PROVIDE FOR THE ADOPTION AND ENFORCEMENT OF THE MARYLAND BUILDING PERFORMANCE STANDARDS, THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL RESIDENTIAL CODE FOR ONE AND TWO FAMILY DWELLINGS AND THE MARYLAND BUILDING REHABILITATION CODE AS STANDARDS FOR THE CONSTRUCTION AND REHABILITATION OF BUILDINGS AND STRUCTURES WITHIN THE CITY.

 

WHEREAS, the City of Frostburg is a municipal corporation of the State of Maryland organized and operating under a charter (“Charter”) adopted in accordance with Article XI-E of the Constitution of Maryland and Article 23-A of the Annotated Code of Maryland, as amended; and

 

WHEREAS, Article V, Section 501 of the Charter empowers the City of Frostburg to regulate the construction of buildings and structures since improperly constructed buildings or structures are detrimental to the health, comfort, and convenience of the residents and visitors of the City of Frostburg; and

 

WHEREAS, under Article VII, Section 1 of the City Code of the City of Frostburg, the City Council establishes standards concerning the construction of buildings and structures in the City of Frostburg; and

 

WHEREAS, the Mayor and City Council of the City of Frostburg desire to amend Article VII, Section 1 of the City Code of the City of Frostburg in order to comply with the Maryland Building Performance Standards.

 

NOW, THEREFORE, in consideration of the foregoing, the Mayor and City Council of the City of Frostburg do ordain and establish this amendment to the City Code of the City of Frostburg as follows:

 

Article VII, Section 1, Subsections (d) through (j) are deleted in their entirety and the following new subsections are inserted in their place:

 

(d) Reference is hereby made to the Maryland Building Performance Standards (MBPS), COMAR 05.02.07, current edition, which in turn references, amends and adopts the International Building Code (IBC) and the International Residential Code for One and Two Family Dwellings (IRC). The standards for construction established in the current editions of said Codes, excluding Section 105 (Permits) of each, as amended, are hereby adopted as the standards for building within the City of Frostburg.

(e) Reference is hereby made to the Maryland Building Rehabilitation Code, COMAR 05.16.01-.08, current edition. The standards for the rehabilitation, renovation, reconfiguration, or modification of existing structures as established in said Code, are hereby adopted as the standards required for building rehabilitation within the City of Frostburg.

(f) Reference is hereby made to the Maryland Plumbing Code, current edition, adopted pursuant to the provisions of the Business Occupations and Professions Article, Title 12, Annotated Code of Maryland. The standards for construction established in said Code are hereby adopted as the standards required for building within the City of Frostburg.

(g) Reference is hereby made to the Maryland Mechanical Code, current edition, adopted pursuant to the provisions of Business Regulation Article §9A-205 Annotated Code of Maryland. The standards for construction established in said Code are hereby adopted as the standards required for building within the City of Frostburg.

(h) Reference is hereby made to the Maryland State Fire Code, COMAR 29.06.01, current edition. The standards for construction established in said Code are hereby adopted as the standards required for building within the City of Frostburg.

AMENDMENT 2001-003

(i) Reference is hereby made to the Maryland Accessibility Code, COMAR 05.02.02, current edition. The standards for construction established in said Code are hereby adopted as the standards required for building within the City of Frostburg.

(j)      Reference is hereby made to the National Electric Code, current edition. The standards for construction established in said Code, as amended by the MBPS and the State Fire Code, are hereby adopted as the standards required for building within the City of Frostburg.
